Terms of Service

1. Service Description

LeadPilot AI provides an AI-powered chatbot platform designed for real estate agents ("Agents" or "Clients"). The Service enables Agents to deploy a custom AI assistant that responds to prospective home buyers and sellers ("Leads" or "End Users"), qualifies them, answers questions about listed properties, and schedules showings.

The AI assistant is a technology tool — it is not a licensed real estate agent, broker, or advisor. See the AI Disclaimer section below for details.

2. Account Registration & Eligibility

To use the Service, you must:

• Be at least 18 years old.
• Be a licensed real estate professional or authorized representative of a licensed brokerage.
• Provide accurate and complete registration information, including your name, email, phone number, and brokerage details.
• Keep your account credentials secure. You are responsible for all activity under your account.

We reserve the right to refuse service, suspend, or terminate accounts at our sole discretion.

3. Payment Terms

The Service is offered on a monthly subscription basis at $149 per month. All payments are processed through Stripe.

• Billing Cycle: Your subscription renews automatically each month on the anniversary of your start date.
• No Contract: There is no long-term contract. You may cancel your subscription at any time.
• Cancellation: You can cancel through your account dashboard or by contacting us at giorgio@getleadpilotai.com. Cancellation takes effect at the end of your current billing period — you retain access until then.
• 30-Day Money-Back Guarantee: If you are not satisfied with the Service within 30 days of your initial subscription, contact us for a full refund. This guarantee applies to first-time subscribers only.
• Price Changes:We may adjust pricing with at least 30 days' written notice. Continued use after a price change constitutes acceptance.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation, including fair housing laws.
• Discriminate against any person based on race, color, religion, sex, national origin, familial status, disability, or any other protected class.
• Provide false, misleading, or deceptive property information.
• Engage in spam, harassment, or unsolicited communications.
• Attempt to reverse-engineer, decompile, or interfere with the Service's infrastructure.
• Use the Service for any purpose other than legitimate real estate business.

Violations may result in immediate suspension or termination of your account without refund.

6. Listing Accuracy

As an Agent using the Service, you are solely responsible for the accuracy, completeness, and legality of all listing data, property descriptions, images, and other content you provide to LeadPilot AI. This includes ensuring compliance with MLS rules, fair housing regulations, and state licensing requirements.

LeadPilot AI does not independently verify listing information. We are not liable for errors, omissions, or misrepresentations in content you supply.

7. Intellectual Property

Our IP: The Service, including its software, design, AI models, brand, and documentation, is owned by LeadPilot AI and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

Your Content: You retain ownership of all content you provide (listings, branding, etc.). By uploading content to the Service, you grant us a license to use it solely for the purpose of operating and improving the Service on your behalf.

8. Data Handling

We take data privacy seriously. Our collection, use, and protection of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you also agree to our Privacy Policy.

As an Agent, you acknowledge that Lead conversation data is processed through third-party AI services to provide chatbot functionality. See our Privacy Policy for a full list of third-party service providers.

9. Limitation of Liability

To the maximum extent permitted by law, LeadPilot AI and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of revenue, profits, or business opportunities.
• Lost or failed real estate transactions.
• Inaccurate information provided by the AI chatbot.
• Service interruptions or downtime.
• Unauthorized access to your account due to your negligence.

Our total aggregate liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied.

10. Indemnification

You agree to indemnify, defend, and hold harmless LeadPilot AI, its founder, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service.
• Content you provide to the Service (listings, branding, etc.).
• Your violation of these Terms or any applicable law.
• Any claim by an End User or third party related to your real estate business or the information your chatbot provided.

11. Termination

By you: You may cancel your subscription and terminate your account at any time. Cancellation takes effect at the end of the current billing period.

By us: We may suspend or terminate your account immediately if you violate these Terms, engage in prohibited conduct, or if required by law. We will make reasonable efforts to notify you in advance unless the violation is severe.

Upon termination, your access to the Service ceases. We will retain your data in accordance with our Privacy Policy and applicable law. You may request deletion of your data by contacting us.

12. Modifications to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through the Service at least 15 days before they take effect. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.

We encourage you to review these Terms periodically. The "Effective Date" at the top reflects the latest revision.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in California.
